The partners

Istat, the Ministry of Justice, and the Ministry of the Interior are the main data producers for criminal judicial statistics in Italy. The Ministry of Defence and the Ministry of Economy and Finance also contribute for specific sectors.

These institutions form the working group which, within the framework of the Sistan (National Statistical System), and more specifically the Quality Circle on “Justice and Security”, together with the Transcrime centre of the Catholic University of Milan, have chosen to collaborate with the United Nations on the project concerning the international classification of crimes (International Classification of Crime for Statistical Purposes – ICCS) proposed by UNODC (United Nations Office on Drugs and Crime).

In particular, work was carried out on the definition, evaluation, and revision of the international classification of crimes, which Italy then tested on criminal proceedings data in 2012 and 2014. The test results led to the revision of the classification until its final draft, approved by the UN Statistical Commission in 2015.

The Workers’ Group, with periodic meetings, both in person and virtual, has produced the transcoding tables from Italian criminal law to international classification, is responsible for validating the update of the thesaurus of crimes, conducted by Istat, with the new norms of Italian legislation, and simultaneously implementing the correspondence of new articles of law with the ICCS.

The new platform will aim to allow all registered and profiled users to participate in the approval flow of changes to be made to the content of the classifications portal to enrich the information offer of the National Statistical System.

The Ministero della Giustizia (Ministry of Justice) is responsible for judicial organisation and performs administrative functions related to civil and criminal jurisdiction. Through the Legislative Office, it oversees the study and proposal of legislative measures, while in the penitentiary sector it implements law and order policies in penitentiary institutions and services. The Ministry also deals with minors and young adults subject to penal measures.
The Directorate-General for Statistics and Organisational Analysis falls under the Department for the Digital Transition of Justice, Statistical Analysis and Cohesion Policies and is part of the National Statistical System. It carries out primary surveys, control, and data management activities related to judicial statistics in civil, criminal, and administrative-accounting matters, as well as data analysis and secondary studies aimed at supporting organisational and decision-making processes and the new information needs of the Ministry.

The Department for Juvenile and Community Justice carries out the functions assigned by law to the Ministry of Justice concerning:

  • implementation of criminal measures issued by the Juvenile Judicial Authority;
  • external penal enforcement and adult probation;
  • implementation of child protection measures in disputes between spouses of different nationalities;
  • cooperation agreements with Local and Territorial Authorities, social private sector entities, and business organisations;
  • deviance prevention, restorative justice, and victim protection.

The Statistical Section, part of Office I of the Head of Department, carries out activities of primary survey, control, processing, and dissemination of the Administration’s statistical data.
The data are published on the Ministry of Justice website www.giustizia.it, in the “Tools – Statistics” section and on the website of the European Centre for Nisida Studies, in the specific section named Archivio statistico.

The Central Criminal Records Office is an office of the Directorate-General for Internal Affairs of the Department of Justice. Within the scope of statistical activities, the Office provides data to other ministerial departments, public administrations, and the judicial authority.
Specifically, each year, it provides data: to the Presidency of the Council of Ministers, for the drafting of the annual Report to Parliament on the state of drug addiction in Italy; to Istat for the annual primary survey of definitively convicted persons; to Consob, each year, the data relating to definitive convictions for the offences referred to in Article 4, paragraph 13-bis of Legislative Decree 58/1998; monthly and annually it publishes statistics relating to the functioning of the interoperability system between European criminal records (ECRIS) on the shared platform CIRCAabc; each year it publishes the Statistica dei certificati prodotti dal casellario giudiziale (https://www.giustizia.it/giustizia/it/mg_1_14.page?selectedNode=0_3_1), a requirement included in the National Statistical Plan; it provides contributions for the completion of the OECD questionnaire on international corruption; it collaborates, for the provision of statistical data, with the Directorate-General for Statistics and Organisational Analysis of the Department of Judicial Organisation.
The office has created the Datamart of the Judicial Records Office, a repository of anonymised definitive judgments made available to the ministry’s departments and intended to meet the needs for statistical data on trends in criminal phenomena.

The Statistical Section is primarily responsible for processing and publishing data on the detained population, personnel, and resources of the Administration, and operates in collaboration with the Directorate-General for Statistics of the Ministry of Justice and with the other Departments of the Ministry.
The Section is part of Sistan and participates in research activities on phenomena relevant to the Administration, international bodies, and the community, such as the study of repeat offending, detention conditions, and the characteristics of detainees and the crimes attributed to them.
The main information processed by the Section is available on the websiteof the Ministry of Justice.

The Supreme Court of Cassation is at the apex of ordinary jurisdiction and has the function of ensuring “the exact observance and uniform interpretation of the law, the unity of national objective law, and respect for the limits of different jurisdictions”. An appeal to the Court of Cassation can be lodged against measures issued by ordinary judges at the appellate level or at the single instance level. The Court of Cassation is also responsible for establishing jurisdiction and competence. The Court of Cassation performs functions concerning legislative elections and popular referendums for the repeal of laws.
The Statistical Office of the Supreme Court of Cassation supports the organisation’s decisions and has a cross-cutting function, measuring every element of work process activities. The Office provides secondary studies in civil, criminal, and administrative fields, in addition to those foreseen in the National Statistical Programme; it participates in the Justice and Security Quality Circle of SISTAN.

Within the Department of Public Security of the Ministry of the Interior, the Direzione centrale Polizia criminale . The Criminal Analysis Service, embedded within the aforementioned Central Directorate, handles inter-agency analysis activities on criminal phenomena, on the evolution of possible operational-level threat scenarios and consequent counter-strategies, providing for this purpose the interpretation and evaluation of relevant statistical data, as well as the development of integrated inter-agency projects in areas of specific competence.

In particular, the third Division carries out quantitative and qualitative analyses of statistical data concerning criminal policing, integrating them with specific collections of information on criminal phenomena and emerging phenomena, which require in-depth analyses; it verifies the correspondence of the information assets of the Criminal Analysis Service with the data present in the inter-agency database, in agreement with the Data Processing Centre (as per Article 8 of Law No. 121 of 1 April 1981); it provides data for the multiple activities of the Service, for research bodies and information agencies; it participates in Working Groups for statistical analysis at national, European, and international levels.

The aforementioned Service produces phenomenal and statistical analyses on the main criminal phenomena in order to study their evolution; it manages a collection of data on completed voluntary homicides, specifically those with female victims; it participates in SISTAN (National Statistical System) and manages relations with the Central Statistical Office and ISTAT.

Military Justice is entrusted by the Constitution (Article 103) with the exercise, in peacetime, of jurisdiction throughout the national territory, with reference to military crimes committed by members of the Armed Forces. Its independence is guaranteed by the Military Judiciary Council, a self-governing body.

The Defence Statistical Office, in accordance with the provisions of Legislative Decree No. 322 of 6 September 1989, concerning rules on the national statistical system, is established at the General Secretariat of Defence – V Department for Technological Innovation, as laid down by the Structural Decree of the General Secretariat, the General Directorates and the Central Offices of the Ministry, in implementation of Article 113, paragraph 4 of Presidential Decree No. 90 of 15 March 2010, containing the consolidated text of regulatory provisions on military organisation.
The Office is headed by a director assisted by staff from the “Relations with Sistan” Section, led by an administrative officer with a degree in Statistical Sciences.

The office coordinates the statistical activities carried out by the Ministry of Defence within the Sistan framework, by preparing the implementation of the three-year programming document, the so-called National Statistical Programme.
Concurrently, it is responsible for the promotion and IT development for statistical purposes of management archives, the collection of administrative data, and the processing and analysis of data concerning the various activities of Defence.

The Ministry of Economy and Finance (MEF), through the statistical office embedded within the Directorate for Institutional Communication, coordinates and manages the exchange of statistical information between the MEF offices and other entities belonging to SISTAN, maintaining relations with ISTAT and the National Statistical Service.
Furthermore, within the MEF, the Department of Finance is responsible for managing statistics on dichiarazioni fiscali e le altre statistiche fiscali within its remit.

Transcrime – Joint Research Centre on Transnational Crime is the inter-university research centre that deals with transnational crime for the Università Cattolica del Sacro Cuore di Milano, the Alma Mater Studiorum – Università di Bologna and the Università degli Studi di Perugia.
Transcrime deals with the analysis and estimation of criminal phenomena; evaluation of crime prevention policies; analysis and identification of criminogenic opportunities in legislation; and the development of risk assessment models and prevention strategies for public and private actors.
